Nursing home costs have risen to immense levels. If you become ill, your family may exhaust your savings and have to apply for nursing home Medicaid. If they do not know exactly how to handle your finances, your children could very well be spending their own resources for your care.

SOME COMMON QUESTIONS THAT I GET…

Q: MY MOTHER NEEDS A LOT OF HELP, SO SHE WILL MOVE INTO MY HOUSE, AND FROM THE SALE OF HER HOME, WE WILL BUILD A MOTHER-IN-LAW SUITE FOR HER. IS THERE ANY PROBLEM WITH THIS STRATEGY IF SHE GOES INTO THE NURSING HOME?

A: YES! Your mother will have to either 1) have her name put on your deed in a proportion of ownership that corresponds to her contribution (which would be subject to a lien if she needs Medicaid), or 2) have 5 years go by after her contribution, or 3) if she goes into a nursing home and requires Medicaid, there will be a large penalty assessed after she runs out of money. You should call.

Q: MY MOTHER NEEDS CARE AT HOME AND HOME HEALTH AGENCIES COST TOO MUCH. SHE HAS A MODEST IRA AND THE MONEY WILL GO QUICK. I FOUND A LADY WHO WILL TAKE CARE OF HER FOR 1/2 THE COST BUT SHE WANTS CASH. IS THIS OK?

A: Ok is relative. If she never needs nursing home care, it is “ok” from the perspective that she won’t face a large penalty for paying out cash that will be considered a gift for failure to follow Medicaid rules, but you have problems with the IRS for not withholding, and since there is no telling what may happen in the future, you may very well have to apply for Medicaid down the road, and there would be a large penalty.  Also, since you are drawing the IRA out, you would be entitled to a huge medical deduction if you weren’t paying someone unlawfully.  There are better options!  Call and find out: (855) ELD-RLAW

WHAT SHOULD I BRING TO AN APPOINTMENT?

Bring anything specific about which you have questions. You should gather information about your income, assets, health and life insurance, property, and any important documents you have such as a power of attorney, will, trust documents, tax returns, Veterans benefits or terms of service, and deeds.

Your consultation is a working meeting, approximately 2 hours long, depending upon your needs. Further discussion may be necessary upon receipt of additional documents if necessary. A report may be provided regarding available options following the meeting.
