Holidays can pose some challenges for your loved ones.

It’s the hap-happiest season of all…but for many who are elderly and may have some dementia, and their families, it can be fraught and lead to meltdowns that can ruin the careful plans for the many festivities you planned.   Just like with younger children, exposure to hours of fun can

 be detrimental as it may lead to overstimulation.  At best, the frantic pace many of us endure can lead to a meltdown and at worst, it can lead to a healthcare crisis.  We just aren’t all going to be able to celebrate the way we used to as we age.  Here are some tips for a more meaningful holiday with your aging loved one:

  • Consider writing out a schedule with times and dates for the various activities you plan to host/join
  • Write out the expected duration of each activity
  • For your loved one who is unable to drive themselves, add in any time traveling, or early/late departure and arrival
  • If the activity is at your or a relative’s home, plan on having a quiet room with a place to rest and invite your loved one to become acquainted with the space so that they can self isolate when it becomes too much.  This is especially important for all day festivities.
  • Plan with your loved one how he or she might want to participate (or not), keeping any mental or physical limitations in mind.  If you plan an afternoon of trivial pursuit, this might make them feel left out and confused if they aren’t up to it.
  • If your loved one is not able to self regulate, limit the exposure to any one event to one hour and have a designated room for them to rest before and after, and select the most meaningful time for them to be engaged
  • If your loved one is homebound, resist the urge to plan events at their home, as this will inevitably be difficult for them, even if they insist.  Instead, plan short visits around times where they are most active.
  • For those with dementia, early hours will often be better as “sundowning” may severely impact their cognition and ability to cope.  Plan a breakfast or brunch instead of a dinner.
  • Plan some safe topics to bring up if your loved one has memory issues, perhaps see if some music may be helpful rather than conversation.
  • Explore memories of holidays past to see if this is a winning topic or one that will make them sad, before the big events.
  • Engage in simple crafts to help them be engaged, something simple like making festive paper chains may make them feel better than complex ornament making
  • Gauge their limits but don’t skip the time together, even if it is simply watching the fireplace or a holiday movie, if your loved one is in a facility or homebound, maybe a visit with one or two relatives at one time for an hour, with something good to eat and to chat, will be enough before they need to rest.

Nursing home costs have risen to immense levels. If you become ill, your family may exhaust your savings and have to apply for nursing home Medicaid. If they do not know exactly how to handle your finances, your children could very well be spending their own resources for your care.

SOME COMMON QUESTIONS THAT I GET…

Q: MY MOTHER NEEDS A LOT OF HELP, SO SHE WILL MOVE INTO MY HOUSE, AND FROM THE SALE OF HER HOME, WE WILL BUILD A MOTHER-IN-LAW SUITE FOR HER. IS THERE ANY PROBLEM WITH THIS STRATEGY IF SHE GOES INTO THE NURSING HOME?

A: YES! Your mother will have to either 1) have her name put on your deed in a proportion of ownership that corresponds to her contribution (which would be subject to a lien if she needs Medicaid), or 2) have 5 years go by after her contribution, or 3) if she goes into a nursing home and requires Medicaid, there will be a large penalty assessed after she runs out of money. You should call.

Q: MY MOTHER NEEDS CARE AT HOME AND HOME HEALTH AGENCIES COST TOO MUCH. SHE HAS A MODEST IRA AND THE MONEY WILL GO QUICK. I FOUND A LADY WHO WILL TAKE CARE OF HER FOR 1/2 THE COST BUT SHE WANTS CASH. IS THIS OK?

A: Ok is relative. If she never needs nursing home care, it is “ok” from the perspective that she won’t face a large penalty for paying out cash that will be considered a gift for failure to follow Medicaid rules, but you have problems with the IRS for not withholding, and since there is no telling what may happen in the future, you may very well have to apply for Medicaid down the road, and there would be a large penalty.  Also, since you are drawing the IRA out, you would be entitled to a huge medical deduction if you weren’t paying someone unlawfully.  There are better options!  Call and find out: (855) ELD-RLAW

Some common questions that I get…

Q: My husband is in the nursing home and the house is in my name.  Will I have to lose the house, or part of it?

A: No, leave it in your name.  If you pass away, though, what does your will say?  Time to change your will and omit the spouse, otherwise, if something happens to you, your husband inherits the house.  If you omit, your heirs would have to pay him 1/3 of the value, but that saves 2/3.  Also make sure you get your own power of attorney done.  Don’t transfer your home until after your husband passes away to avoid a penalty.  There are still plenty of other assets you can keep.  You should call.

Q: My mother wants me to take care of her in my home. Is it okay for her to pay for an addition?

A: Not unless you have 5 years to wait.  Any amounts contributed to you will be considered a transfer without compensation and would be subject to a penalty if she goes into a nursing home or you agree to a lien on the home.  Get a consultation before taking this course of action.

Aging in Alabama had a great year thanks to our clients, our healthcare affiliates, and referring professionals.  Thanks to all for helping us off to a great start!  We are humbled and proud to serve you!

What’s been going on?

It’s been great to see more people calling and coming in for early planning.  Still have lots of emergencies coming in.  We can always do something but early planners will save so much more.  Most troubling are the number of people without powers of attorney despite years of progressing dementia.  We have to go to court in order to open a QIT for the nursing home or list property.  Very sad and very expensive.  Get that power of attorney!  Common questions we are getting:
